Pyraman SaaS Terms of Use and Terms & Conditions
These Terms of Use and Terms & Conditions (“Terms”) govern access to and use of the Pyraman platform and related services provided by 4C Consulting Private Limited (“4C Consulting”, “Company”, “we”, “our”, or “us”).
By accessing, subscribing to, or using Pyraman, the customer organization and its authorized users (“Customer”, “you”, or “your”) agree to be bound by these Terms.
About Pyraman
Pyraman is a cloud-based operational management platform owned, developed, and operated by 4C Consulting Private Limited.
The platform provides modules and services including but not limited to:
- Document Management
- Record Management
- Audit Management
- Training Management
- Complaint Management
- Non-Conformity Management
- Objective Management
- MOM Management
The features and functionality available to a customer may vary depending on the subscribed plan.
Subscription and Licensing
Upon payment of applicable subscription fees, 4C Consulting grants the Customer a limited, non-exclusive, non-transferable, revocable license to access and use Pyraman solely for internal business purposes.
This license does not transfer any ownership rights in Pyraman or its underlying technology.
Customers may not:
- Sell, sublicense, distribute, or transfer Pyraman
- Reverse engineer, decompile, or attempt to derive source code
- Create derivative works from Pyraman
- Copy platform functionality for commercial purposes
- Remove proprietary notices or trademarks
Subscription Fees and Billing
The standard annual subscription fee for Pyraman is:
- ₹60,000 per year for up to 10 users
- Additional users may be added as per prevailing pricing plans
All subscription fees:
- Are payable in advance
- Are exclusive of applicable taxes
- Are non-refundable
- Must be paid within agreed payment terms
Failure to pay subscription fees may result in suspension or termination of access.
No Refund Policy
All fees paid for subscriptions, implementation, training, support, consulting, configuration, customization, or related services are non-refundable.
No refunds, credits, or partial reimbursements shall be provided for:
- Partial usage
- Unused licenses
- Early termination
- Customer inactivity
- Dissatisfaction resulting from factors outside the Company’s control
Customer Responsibilities
The Customer is responsible for:
- Maintaining accurate account information
- Protecting user credentials
- Managing user permissions
- Ensuring lawful use of the platform
- Obtaining all necessary consents required for uploaded information
- Complying with applicable laws and regulations
Customers shall not:
- Upload malicious software
- Upload unlawful content
- Interfere with platform security
- Attempt unauthorized access
- Use Pyraman for illegal activities
Customer Data Ownership
All documents, records, files, reports, and information uploaded by the Customer into Pyraman remain the sole property of the Customer.
4C Consulting does not claim ownership over customer data.
The Customer is solely responsible for:
- Accuracy of uploaded data
- Legality of uploaded data
- Compliance with applicable regulations
- Maintaining backups where necessary
Intellectual Property Rights
All rights, title, and interest in Pyraman including:
- Software
- Source code
- User interfaces
- Designs
- Workflows
- Logos
- Documentation
- Trademarks
remain the exclusive property of 4C Consulting Private Limited.
Nothing in these Terms transfers intellectual property ownership to the Customer.
Data Retention and Deletion
Upon expiration or termination of a subscription:
- Customer data will remain available for retrieval for up to 90 days
- Customers may request data export during this period
- After the retention period, data may be permanently deleted
4C Consulting shall not be responsible for data loss resulting from failure to export data within the retention period.
User Accounts and Security
Customers are responsible for:
- User provisioning
- Access management
- Password confidentiality
- Monitoring authorized use
Any activity occurring through customer accounts shall be deemed authorized by the Customer.
Customers must immediately notify 4C Consulting of any suspected unauthorized access.
Service Availability
4C Consulting aims to maintain a target service availability of 99% uptime.
Planned maintenance, upgrades, emergency maintenance, force majeure events, internet disruptions, and third-party service failures may impact availability.
The uptime target is a service objective and does not constitute a contractual guarantee.
Support Services
Standard support includes:
- Email-based support
- Issue investigation
- Guidance on platform usage
Support requests may be submitted through designated support channels.
Target resolution time is generally within 72 working hours, depending on issue complexity and severity.
Extended timelines may apply and will be communicated where necessary.
Notifications and Communications
Pyraman may send:
- Workflow notifications
- Approval reminders
- Audit reminders
- Training reminders
- System alerts
- Service communications
Delivery of notifications depends on third-party infrastructure and internet connectivity.
4C Consulting does not guarantee delivery of every notification.
Third-Party Services
Pyraman may rely on third-party providers for:
- Hosting
- Email services
- Cloud infrastructure
- Security monitoring
- Communication services
4C Consulting is not responsible for interruptions or failures caused by third-party providers beyond its reasonable control.
Limitation of Liability
To the maximum extent permitted by law, 4C Consulting shall not be liable for:
- Indirect damages
- Consequential damages
- Loss of profits
- Loss of revenue
- Loss of business opportunities
- Loss of goodwill
- Loss of data
The aggregate liability of 4C Consulting arising out of or related to Pyraman shall not exceed the total subscription fees paid by the Customer during the twelve (12) months preceding the event giving rise to the claim.
Disclaimer of Warranties
Pyraman is provided on an “as available” and “as is” basis.
4C Consulting does not warrant that:
- The platform will be uninterrupted
- The platform will be error-free
- Every defect will be corrected
- The platform will meet every customer requirement
Customers use Pyraman at their own discretion and risk.
Regulatory Compliance
While Pyraman is designed to support management systems and operational processes, the Customer remains solely responsible for:
- Regulatory compliance
- Legal compliance
- Certification compliance
- Internal governance requirements
Use of Pyraman does not guarantee compliance with any standard, law, regulation, certification, or audit requirement.
Suspension and Termination
4C Consulting may suspend or terminate access without prior notice in cases involving:
- Non-payment
- Unauthorized access
- Security threats
- Violation of these Terms
- Illegal activities
- Abuse of platform resources
Upon termination:
- Access rights immediately cease
- License rights terminate
- Data retention provisions continue to apply
Force Majeure
Neither party shall be liable for failure or delay resulting from circumstances beyond reasonable control, including:
- Natural disasters
- Government actions
- Cyberattacks
- Internet outages
- Labor disputes
- Power failures
- Pandemic events
- Telecommunications disruptions
Modifications to Services and Terms
4C Consulting may:
- Modify platform functionality
- Introduce new features
- Discontinue features
- Update these Terms
Updated Terms will be published through Pyraman or the official website.
Continued use of Pyraman constitutes acceptance of revised Terms.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any dispute arising from or relating to Pyraman shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India.
